1 Area of validity
The General Terms and Conditions only apply to entrepreneurs within the meaning of Section 14 of the German Civil Code (BGB) and to partnerships with legal capacity or small businesses, associations or organisations under public law (hereinafter referred to as “Customer” or “Customers”).
§2 Conclusion of a contract, storage of the contract text
The following provisions on the conclusion of a contract apply to orders placed with the company Anton Schulz Metallkarten. It is irrelevant whether the contract was concluded by telephone, in person or in writing (email).

§3 Prices, shipping costs, payment, due date
(1) The customer shall settle the invoice using the contractually agreed means of payment.
(2) If the customer has chosen to pay in advance, he undertakes to pay the purchase price immediately after conclusion of the contract.
(3) The invoice is due immediately. Particularly in the case of contracts with new customers, payment prior to delivery is mandatory unless otherwise agreed. Metallkarte Schulz shall be entitled to withhold production and delivery of the cards until payment of the invoice has been received or corresponding proof has been provided.
§4 Delivery
(1) Unless otherwise contractually agreed, the ordered goods shall be delivered to the address specified by the customer.
(2) Delivery shall be “free domicile” (CPT Incoterms 2010)
(3) Delivery shall be made via standard shipping according to a shipping service provider selected by Metallkarten Schulz. Should the customer require express delivery, this must be notified prior to despatch. A corresponding additional fee may be charged.
(4) The production and delivery times communicated by Metallkarten Schulz are estimated times. Metallkarten Schulz points out that neither the production nor the delivery time can be guaranteed. The customer acknowledges that in the event of a later delivery time, he cannot claim compensation.
§5 Retention of title
We reserve title to the goods until the purchase price has been paid in full.
§6 Right of cancellation
You have the right to cancel this contract within fourteen days without giving any reason.
The cancellation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the goods.

of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or e-mail). You can use the attached sample cancellation form, but this is not mandatory.
Widerrufsfolgen
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this repayment.
We may withhold reimbursement until we have received the goods back or until you have supplied evidence of having sent back the goods, whichever is the earliest.
You must return or hand over the goods to us immediately and in any case no later than fourteen days from the day on which you inform us of the cancellation of this contract. The deadline is met if you dispatch the goods before the period of fourteen days has expired.
You shall bear the direct costs of returning the goods.
Reasons for exclusion or cancellation
The right of cancellation does not apply to contracts
for the delivery of goods if they have been inseparably mixed with other goods after delivery due to their nature;
End of the cancellation policy
for the delivery of goods which are not prefabricated and for the manufacture of which an individual selection or determination by the consumer is decisive or which are clearly customised to the personal needs of the consumer;
The right of cancellation expires prematurely for contracts
for the delivery of sealed goods that are not suitable for return if their seal has been removed after delivery.

§8 Warranty
The statutory warranty regulations apply.
According to the current state of technology, data communication via the Internet cannot be guaranteed to be error-free and/or available at all times. Anton Schulz Metallkarten is therefore not liable for the constant and uninterrupted availability of its online shop or for delays in processing orders due to technical and electronic errors over which Anton Schulz Metallkarten has no influence.
§9 Data protection
By sending the order, the customer authorises Anton Schulz Metallkarten to process, store, evaluate and use the data received in connection with the business relationship in accordance with the data protection laws.
The customer has a right to information as well as a right to correction, blocking and deletion of his stored data.
Detailed information on the type and scope of data storage of personal data is available to the customer under the menu item “Privacy Policy”.
§10 Placement of products as advertising material
Unless otherwise agreed in writing prior to conclusion of the contract, the customer authorises Anton Schulz Metallkarten to use the products individually manufactured for him as advertising material for the acquisition of new customers and presentation. Anton Schulz Metallkarten is free to decide whether the products are made available in the form of photos, videos or sample copies/duplicates. Anton Schulz Metallkarten will endeavour to make personal information unrecognisable as far as is possible and aesthetically pleasing. Should the de-recognition lead to a deterioration of the overall image of the product, the de-recognition will be waived. Anton Schulz Metallkarten accepts no liability for any duplication of the information on the products. Should a customer inform us in writing after conclusion of the contract that his products are not to be used as advertising material, Anton Schulz Metallkarten will endeavour to comply with this request. Any costs incurred for the unrecognisability or deletion of the products will be charged to the customer after notification.
